Privacy Policy
Effective October 15 2024
Who we are
Boulder Union Incorporated runs Boulder Union, a bouldering gym at 174 Union Street, New Bedford, MA 02740. In this policy, "Boulder Union," "we," "us," and "our" mean Boulder Union Incorporated.
What this policy covers
This policy explains what personal information we collect, why we collect it, who we share it with, and the choices you have. It applies when you visit boulderunion.com, buy a pass or membership, sign our waiver, climb at the gym, join a class, camp, party, or event, or hear from us by email or text.
It does not cover information that has been combined or stripped of identifiers so it can no longer reasonably be tied to you, such as total check-ins per day.

Name, email, phone number, and mailing address
Date of birth and age
Emergency contact name and phone number

For minors: the parent or guardian's name, contact details, and consent

Health or injury information you choose to share with staff, or that we record in an incident report
Program, party, and event registrations, survey answers, and comp results
Anything you send us by email, text, live chat, social media, phone, or at the desk
Payment information. Card payments are handled by our payment processors. We see limited details, such as the card type and last four digits. We do not store full card numbers.
Gym activity. Our gym management system records check-ins, visit dates, passes and memberships purchased, and billing history. We may take a photo at signup so the desk can match you to your account.
Website and device information. When you visit boulderunion.com, we and our providers collect your IP address, browser and device type, pages viewed, how you arrived (for example from Instagram or Google), and time on the site. This comes from cookies, pixels, and similar tools.
Cookies and pixels. We use cookies for the site to work, to understand traffic, and to measure our ads. This includes analytics from our website host and the Meta Pixel, which tells Meta when someone who saw our ad visits the site or completes a purchase. You can block or delete cookies in your browser settings. Some parts of the site may not work as well without them.

How we share your information
We do not sell your personal information. We share it only as described here.
Service providers. Companies that help us run the gym get the information they need to do that work, and may not use it for their own purposes. These include our gym management and waiver system, payment processors, website host, email and text message platforms, live chat, analytics, advertising platforms, payroll, and our accountants and attorneys.
Partners you sign up through. If you come through a school, youth organization, employer, or college group program, we may confirm your participation or attendance with that organization.
Legal and safety reasons. We may share information when the law requires it, to respond to valid legal requests, to protect the safety of anyone at the gym, or to deal with an insurance claim or dispute.
Business changes. If Boulder Union is sold, merged, refinanced, or restructured, personal information may transfer to the new owner or be reviewed as part of that process, under this policy.
We will not share your information with other companies for their own marketing without your permission.
Email and text messages
Email. If you give us your email and agree to hear from us, we may send news, offers, and event announcements. Every marketing email has an unsubscribe link.
Text messages. You can sign up for Boulder Union texts by texting CLIMB to our number or checking the text consent box when you sign up. By opting in, you agree to receive recurring automated marketing texts from Boulder Union at the number you gave. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply.
Reply STOP at any time to stop texts. You will get one message confirming you are unsubscribed.
Reply HELP for help, or contact us using the details below.
Carriers are not liable for delayed or undelivered messages.
Your mobile information stays with us. We do not share or sell mobile phone numbers or text message opt-in data with third parties or affiliates for their marketing. Numbers are shared only with the providers that deliver our texts.
Account messages. If you opt out of marketing, we may still contact you about your account, billing, bookings, waiver, or safety.
Photos, video, and security cameras
Security cameras. The gym records security video at all times, during open hours, events, and when the gym is closed. Cameras cover public areas for safety, security, and incident review. Cameras are never placed in restrooms, showers, or changing areas, and they do not record audio. Footage is kept for a limited time and then recorded over, unless we need it for an incident, claim, or legal matter.
Photos and video. Staff and photographers we hire take photos and video at the gym and at events. Our waiver includes a photo and video release. By signing it, you agree that we may photograph and film you while you are at the gym, and use those images on our website, social media, and marketing. A parent or guardian who signs the waiver for a minor gives this consent for the minor. If you would rather not appear in something we posted, email us and we will consider removing it.
Children and teens
Kids climb here, so we collect some information about minors. A parent or guardian signs the waiver for anyone under 18 and provides the child's name, date of birth, and emergency contacts. Youth programs, camps, and parties are booked by a parent or guardian.
Our website and marketing are meant for adults. We do not knowingly collect personal information online from children under 13 without a parent or guardian's consent, and we do not send marketing texts or emails to children. If you think a child gave us information without consent, contact us and we will delete it.
How long we keep information
We keep personal information only as long as we need it for the reasons in this policy, or as long as the law, our insurers, or our accountants require.
Signed waivers and incident reports are kept for several years after your last visit, because they may be needed for insurance or legal claims. For minors, this can extend past their 18th birthday.
Billing and tax records are kept as long as tax and accounting rules require.
Marketing contact details are kept until you unsubscribe or ask us to delete them.
Security camera footage is recorded over on a rolling basis unless it is saved for an incident.
When we no longer need information, we delete it or remove anything that identifies you.
Your choices and rights
You can ask us to:
Show you the personal information we have about you
Correct information that is wrong or out of date
Delete your information
Stop sending you marketing emails or texts
Stop using your photo in our marketing
Many account details can be updated in the member portal or at the desk. For anything else, email us. We may need to confirm your identity first. We will respond within a reasonable time, generally within 30 days.
Some information we have to keep even if you ask us to delete it, such as signed waivers, incident reports, and billing records. If so, we will tell you what we kept and why.
Ads and tracking. You can limit ad tracking through your browser, your device's ad settings, and the ad preferences in your Facebook and Instagram accounts. Our site does not currently respond to browser "Do Not Track" signals.
Security
We use reasonable safeguards to protect personal information, including password-protected systems, access limited to staff who need it, and providers that encrypt payment data. No system is perfectly secure. If a breach affects your personal information, we will notify you and the appropriate authorities as Massachusetts law requires.
Other websites
Our site links to other sites, such as our booking portal, Instagram, and partner organizations. Their privacy practices are their own, so check their policies.
Changes to this policy
We may update this policy as the gym and our tools change. We will post the new version here with a new effective date. If a change is significant, we will also let members know by email.
