Boulder Union
terms & conditions
Effective October 15 2024
Who we are
Boulder Union Incorporated runs Boulder Union, a bouldering gym at 174 Union Street, New Bedford, MA 02740. In these terms, "Boulder Union," "we," "us," and "our" mean Boulder Union Incorporated.
Agreeing to these terms
These terms apply when you visit boulderunion.com, use our booking portal, buy a pass, membership, gift card, or program, come into the gym, or sign up for our emails or texts. By doing any of these, you agree to these terms. If you do not agree, please do not use our services.
Some services come with their own agreements, such as the waiver, a membership agreement, or a party booking. If one of those conflicts with these terms, that agreement controls for that service.
Using our website and booking portal
Use our website and booking portal only for lawful purposes. Keep your account login private and your information accurate and up to date. You are responsible for activity on your account.
You may not:
Try to access accounts, systems, or data that are not yours
Interfere with the site, the portal, or our payment systems
Buy passes or memberships with false information or someone else's payment method without permission
Copy or resell passes, memberships, or event spots
We try to keep prices, schedules, and event details on the site accurate, but mistakes happen. We may correct errors and cancel or adjust an order placed at an incorrect price, with a refund of anything paid.
Memberships, passes, and payments
Memberships. Memberships are personal and cannot be shared or transferred. Rates, eligibility, billing dates, freezes, and cancellation terms are set out in your membership agreement and shown when you join. Discounted rates may require proof of eligibility, such as a valid student ID, and we may move a membership to the standard rate if eligibility ends.
Recurring billing. Monthly and weekly memberships renew and bill automatically to the payment method on file until cancelled. Cancelling is your responsibility. You can cancel in the member portal or at the desk, by the deadline in your membership agreement. Payments that come due before you cancel are not refunded.
Promotions. Promotional rates and free periods apply only on the terms stated with the offer, usually to new members only. Unless an offer says otherwise, a membership moves to the regular rate for its tier when the promotion ends.
Guest passes. Members get two guest passes a month, and each pass must be used for a different person. Every guest needs a signed waiver before climbing. Unused guest passes do not carry over to the next month.
Day passes and punch cards. Passes are for the person named on them and cannot be resold.
Gift cards. Gift cards can be used for passes, memberships, programs, and other purchases at Boulder Union. They cannot be redeemed for cash except where the law requires, and they do not expire for at least seven years from the date of issue.
Payments. Payments are handled by third-party payment processors. You agree to provide a valid payment method and to pay all charges at the prices in effect when you buy. If a recurring payment fails, we will try your card again. You cannot climb until unpaid dues are paid. If the dues stay unpaid for three months, or you choose not to pay them, your membership is cancelled. After that, you can climb with a day pass or rejoin at the membership pricing and fees in effect at that time.
Refunds. Refund and cancellation terms vary by product and are shown at the time of purchase. Where none are shown, passes, membership dues, and program fees are not refundable once used or once the billing period has started, except where the law requires otherwise.
Prices and offerings. We may change prices, membership types, hours, and programs. Price changes for an existing membership take effect only after notice as described in your membership agreement.
Waiver and risk
Bouldering and fitness training carry real risk of injury, including from falls, landing on mats, and falling holds. Everyone who climbs or uses the fitness room must have a signed Boulder Union waiver on file before their first visit. The waiver governs your participation and controls over anything in these terms about physical activity.
Gym rules and conduct
While at the gym, you agree to follow posted rules, safety guidelines, and staff instructions. You agree not to:
Climb or train in a way that puts you or others at risk
Damage the building, walls, holds, mats, or equipment
Harass, threaten, or mistreat staff or other climbers
Enter closed areas or use the gym outside your access
Areas marked staff only are off limits unless staff say otherwise.
We may refuse entry, end a visit, or suspend or cancel a membership for unsafe behavior, rule violations, or conduct that harms other guests or staff. If we cancel a membership for cause, we are not required to refund amounts already paid.
Personal belongings. Cubbies are open shelving, so use them at your own risk. We are not responsible for lost, stolen, or damaged property.
Minors, programs, and events
Minors. A parent or guardian must sign the waiver for anyone under 18. Climbers under 15 need a parent or guardian in the building for their whole visit. Climbers 15 to 17 may climb without a parent on site once a parent or guardian has signed the waiver. Parents and guardians are responsible for their children's behavior and safety at the gym.
Classes, camps, and youth programs. Registration, attendance, and refund terms for each program are shown at signup. We may change instructors or schedules, or cancel a session with low enrollment. If we cancel a session, what you receive depends on the program and its terms.
Parties and private events. Bookings are confirmed once the deposit or payment is received. Every participant needs a signed waiver before climbing. The party's booking terms cover rescheduling and cancellation.
Competitions. Comps and other events may have their own rules, entry fees, and refund terms, shown at registration. Results and judging decisions made by event staff are final.

The gym is recorded by security cameras at all times. Staff and photographers we hire also take photos and video at the gym and at events. The photo and video release in our waiver covers how we may use those images. Our Privacy Policy explains how to ask us to remove one.
